公司能要求離職員工承擔工作服制作費用嗎?
用(yong)(yong)人(ren)單(dan)位(wei)要(yao)求員(yuan)工(gong)(gong)(gong)穿著工(gong)(gong)(gong)作(zuo)服(fu)(fu),員(yuan)工(gong)(gong)(gong)離(li)職時用(yong)(yong)人(ren)單(dan)位(wei)要(yao)求離(li)職員(yuan)工(gong)(gong)(gong)承擔(dan)工(gong)(gong)(gong)作(zuo)服(fu)(fu)費(fei),甚至某些用(yong)(yong)人(ren)單(dan)位(wei)更以不為離(li)職員(yuan)工(gong)(gong)(gong)辦理檔(dang)案和(he)社會保險關系轉移手續為由(you)要(yao)挾離(li)職員(yuan)工(gong)(gong)(gong)承擔(dan)工(gong)(gong)(gong)作(zuo)服(fu)(fu)費(fei)用(yong)(yong)。請問(wen):公(gong)司能要(yao)求離(li)職職工(gong)(gong)(gong)承擔(dan)工(gong)(gong)(gong)作(zuo)服(fu)(fu)制作(zuo)費(fei)用(yong)(yong)嗎?

年1月,林先生(sheng)(sheng)與某公司(si)(si)簽(qian)訂了(le)(le)用(yong)工合同,期(qi)限為3年。到2017年1月期(qi)滿后(hou),林先生(sheng)(sheng)跟公司(si)(si)提出(chu)了(le)(le)離職申請(qing),但在辦理離職手續時,卻(que)被公司(si)(si)要求需按40%交(jiao)(jiao)納工作服折(zhe)舊費(fei)用(yong)并(bing)進行工作服回收,折(zhe)舊費(fei)用(yong)總(zong)計是1440元。如林先生(sheng)(sheng)不交(jiao)(jiao)折(zhe)舊費(fei),公司(si)(si)就不辦檔案轉移等離職手續。
濟南服裝加工廠//itaou.cn/林先生稱(cheng),入職時公司(si)給自己訂制了一整套(tao)工(gong)(gong)作(zuo)(zuo)服(fu),包(bao)括春夏秋冬四季總共(gong)10多件(jian),去年8月公司(si)重新定做(zuo)工(gong)(gong)作(zuo)(zuo)服(fu),到手時是去年11月。新工(gong)(gong)作(zuo)(zuo)服(fu)確(que)實(shi)使(shi)用(yong)(yong)不到一年,按公司(si)相(xiang)關規(gui)定,工(gong)(gong)作(zuo)(zuo)服(fu)使(shi)用(yong)(yong)不足一年的(de)離(li)職需(xu)歸還工(gong)(gong)作(zuo)(zuo)服(fu),并且交納工(gong)(gong)作(zuo)(zuo)服(fu)折損費(fei),可即(ji)便如此林先生認為這(zhe)部分費(fei)用(yong)(yong)也是不合(he)理的(de)。
對(dui)此(ci),公司(si)人(ren)事經理(li)(li)說,公司(si)的(de)服裝分為(wei)勞動保護(hu)(hu)服和工(gong)作服兩類(lei),勞動保護(hu)(hu)服包(bao)括安(an)全(quan)帽(mao)、夜光衣以及防砸鞋等(deng),這(zhe)些都是為(wei)員工(gong)們免費提供的(de),不收取折(zhe)舊(jiu)費。而工(gong)作服每件都是為(wei)員工(gong)量身定做(zuo)(zuo)的(de),是有一(yi)定成本的(de)。公司(si)人(ren)事經理(li)(li)還說,這(zhe)種做(zuo)(zuo)法也是全(quan)國同行業一(yi)些通用的(de)做(zuo)(zuo)法。
律師說法
根據(ju)《勞(lao)(lao)動(dong)法》及《安全生(sheng)(sheng)產法》的相關規定(ding),用(yong)(yong)(yong)人(ren)單(dan)位必須為勞(lao)(lao)動(dong)者提(ti)(ti)供符合(he)國(guo)家規定(ding)的勞(lao)(lao)動(dong)安全衛生(sheng)(sheng)條件以及必要(yao)的符合(he)國(guo)家標準或(huo)者行業標準的勞(lao)(lao)動(dong)防(fang)護(hu)(hu)(hu)用(yong)(yong)(yong)品(pin)(例如:工(gong)(gong)(gong)(gong)作帽子、工(gong)(gong)(gong)(gong)作服(fu)、防(fang)護(hu)(hu)(hu)服(fu)、工(gong)(gong)(gong)(gong)作手(shou)套等(deng))。也就(jiu)是說,如果(guo)勞(lao)(lao)動(dong)者在(zai)勞(lao)(lao)動(dong)過程中為免遭或(huo)減(jian)輕(qing)事故傷害或(huo)職業危害需要(yao)穿著工(gong)(gong)(gong)(gong)作服(fu)或(huo)使用(yong)(yong)(yong)相關勞(lao)(lao)動(dong)防(fang)護(hu)(hu)(hu)用(yong)(yong)(yong)品(pin),那么(me)該工(gong)(gong)(gong)(gong)作服(fu)等(deng)勞(lao)(lao)動(dong)防(fang)護(hu)(hu)(hu)用(yong)(yong)(yong)品(pin)屬(shu)于工(gong)(gong)(gong)(gong)作中應當(dang)具(ju)備(bei)的勞(lao)(lao)動(dong)條件,提(ti)(ti)供工(gong)(gong)(gong)(gong)作服(fu)等(deng)勞(lao)(lao)動(dong)防(fang)護(hu)(hu)(hu)用(yong)(yong)(yong)品(pin)是用(yong)(yong)(yong)人(ren)單(dan)位的義務,用(yong)(yong)(yong)人(ren)單(dan)位應當(dang)無(wu)償提(ti)(ti)供。
如果勞動(dong)(dong)者(zhe)在工作(zuo)中(zhong)并不需要(yao)使用(yong)工作(zuo)服(fu)(fu)等勞動(dong)(dong)防護用(yong)品,但(dan)用(yong)人單(dan)(dan)位(wei)為了(le)提升企業(ye)形象和展示企業(ye)文化內涵而(er)要(yao)求勞動(dong)(dong)者(zhe)穿(chuan)著(zhu)(zhu)工作(zuo)服(fu)(fu)的情況下,筆者(zhe)認為,勞動(dong)(dong)者(zhe)穿(chuan)著(zhu)(zhu)工作(zuo)服(fu)(fu)是用(yong)人單(dan)(dan)位(wei)的單(dan)(dan)方要(yao)求并且勞動(dong)(dong)者(zhe)穿(chuan)著(zhu)(zhu)工作(zuo)服(fu)(fu)有(you)利于(yu)用(yong)人單(dan)(dan)位(wei)的宣(xuan)傳,給用(yong)人單(dan)(dan)位(wei)帶來經(jing)濟效益,因此,工作(zuo)服(fu)(fu)的制作(zuo)費用(yong)應當由用(yong)人單(dan)(dan)位(wei)承擔。
在本(ben)案中,無論是工(gong)作(zuo)所需還是為了提升企業形象(xiang),公司要求員(yuan)工(gong)穿著工(gong)作(zuo)服(fu),該工(gong)作(zuo)服(fu)的(de)制作(zuo)費用(yong)應當由用(yong)人單位(wei)承擔(dan)。公司要求林先生支付(fu)工(gong)作(zuo)服(fu)的(de)折(zhe)損費于法無據。
此外,根(gen)據《勞(lao)動(dong)合(he)同法》第五十條明(ming)確規定:“用人(ren)單(dan)位(wei)應當在解除(chu)(chu)或者(zhe)終(zhong)(zhong)止勞(lao)動(dong)合(he)同時出具解除(chu)(chu)或者(zhe)終(zhong)(zhong)止勞(lao)動(dong)合(he)同的證明(ming),并在十五日內為(wei)勞(lao)動(dong)者(zhe)辦理檔(dang)案和社(she)會保(bao)險關系轉移手續。”在本案中,如(ru)林(lin)先生不交工作服折舊費,公司就不為(wei)其辦理檔(dang)案轉移等離(li)職手續的行為(wei)已違反了上述規定,林(lin)先生有權向(xiang)當地(di)勞(lao)動(dong)行政部門進(jin)行反映,由勞(lao)動(dong)行政部門責(ze)令用人(ren)單(dan)位(wei)進(jin)行改正。
